Terms of service

  1. RELOOP is offered by Glam Corner Pty Ltd ABN 43 155 435 788 (we, us, GlamCorner)
  2. These Terms apply in addition to the GlamCorner Terms and Conditions.
  3. If you choose to participate in RELOOP then these Terms apply to you. These Terms form together with the Glam Corner Terms and Conditions the entire agreement between you and us in relation to our provision of RELOOP services to you and replace any prior representation or agreement. You acknowledge that these Terms supersede any other terms or conditions provided to you by us in connection with our provision of RELOOP services to you. For the avoidance of doubt, to the extent that there are any inconsistencies between these terms and the GlamCorner Terms and Conditions, these Terms will prevail to the extent of the inconsistency in respect of your participation in RELOOP.

What is RELOOP? 

      4. RELOOP is recommerce-as-a-service offered by GlamCorner to you and allows you to send the items you have purchased (including from any of our retail partners) to GlamCorner to sell on your behalf in accordance with these Terms. 

      5. RELOOP can be accessed via our website at https://reloop.com.au

Who can participate in RELOOP? 

      6. You must either have an existing RELOOP account or register for one pursuant to these Terms in order to participate in RELOOP.  

      7. You must be at least 13 years old to participate in RELOOP. If you are at least 13 years old but under the age of 18, you must have parental/guardian approval to participate in RELOOP and to register for a RELOOP account. Your parent/guardian must read and consent to these Terms and the GlamCorner Terms and Conditions.

Definitions

      8. In these Terms:  

           a. Business Day means a day that is not a Saturday, Sunday, public holiday or bank holiday in Sydney, New South Wales. 

            b. GlamCorner Terms and Conditions means the GlamCorner Terms and Conditions which are available at https://www.glamcorner.com.au/info/terms.

            c. Minimum Listing Period means the minimum period of time that the item will be listed (unless sold prior) before GlamCorner may determine, in its sole discretion, to remove the item. The Minimum Listing Period is 120 days or such other period determined by GlamCorner from time to time to ensure that items have the best chance of success at being sold through RELOOP, and to adjust to market demand.

            d. Product Listing Guidelines means any product listing guidelines notified to you by GlamCorner from time to time, and includes the product listing guidelines set out in clause 52. 

            e. RELOOP Starter Kit means the kit we send you with information about RELOOP and a prepaid satchel for you to fill with your items to RELOOP and return to the Fulfilment Centre.

            f. Terms means these terms and conditions. 

            g. ACL, Claims, Fulfilment Centre, Government Agency, Law, Loss, Privacy Policy and Store have the meanings set out in clause 1.1 of the GlamCorner Terms and Conditions. 

      9. The "Interpretation" clauses set out in clause 1.2 of the GlamCorner Terms and Conditions apply to these Terms.

What information do we take?

      10. When creating a RELOOP account, or listing an item for RELOOP which you have not purchased from one of our retail partners, you must provide us with your personal information including your name, email address and address. This information must be accurate and current.  

      11. Where you have purchased an item eligible for RELOOP via one of our retail partners, we will obtain your personal information including your name, email address, address and order information from that retail partner. 

      12. Further information about the personal information which we collect and the way in which we handle your personal information is set out in the Privacy Policy (which is available at https://www.glamcorner.com.au/info/terms/privacy). Please review our Privacy Policy. You agree that, by participating in RELOOP including by creating an account, listing an item for RELOOP or purchasing an eligible product through one of our retail partners, you have read our privacy policy, understood its contents and consented to its requirements. 

What is our relationship with you?

      13. You are the "bailor" of your item(s) and we are the "bailee". This means that you are the owner of your item(s) and you are entrusting us with your item(s) without transferring ownership of your item(s) to us. 

      14. Nothing in these terms may be construed as creating a relationship of employer and employee, of partnership, of principal and agent or of trustee and beneficiary.

Title and Risk 

      15. You retain title to your item(s) at all times until we sell your item(s) to a third party customer and:

            a) the item(s) are delivered to the third party customer; and 

            b) the third party customer has paid all amounts owing in respect of the item(s). 

This means that you retain ownership of your item(s) even after the item(s) are received by us.

      16. All risk in, and liability for, the item(s) including loss, theft, or destruction of the item(s) remains with you unless and until such time that title to the item(s) is passed to a third party customer pursuant to clause 15 above. 

GlamCorner's liability 

      17. Subject to clause 19, to the extent permitted by law, GlamCorner will not be liable for any loss, cost, damage, or claim suffered or incurred by you or any third party in connection with the loss, theft, or destruction of the item(s) at any time. This does not limit any of your rights under the ACL as set out in clauses 20 and 21.

      18. Notwithstanding clauses 16 and 17, where an item is lost or damaged while in GlamCorner's care (that is, after the item is received at GlamCorner's Fulfilment Center) GlamCorner will either repair the item or: 

            a) pay to you the amount the item is listed/to be listed for on RELOOP; or 

            b) pay to you the amount you paid for the item as set out in your proof of purchase (which you must provide to GlamCorner pursuant to clause 51). 

            whichever is the lesser amount. 

      19. GlamCorner will determine in its sole discretion (acting reasonably) whether to repair the item or compensate you pursuant to this clause 18. 

      20. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the ACL or any other applicable Law that cannot be excluded, restricted or modified by agreement.

      21. To the fullest extent permitted by Law, GlamCorner's liability for a breach of a non-excludable guarantee referred to in clause 20 is limited to, in the case of services supplied or offered by GlamCorner:

            a) the supplying of the services again; or

            b) the payment of the cost of having the services supplied again.

      22. Despite any other provision of these Terms, clauses 17 to 22 survive the expiry or termination of these Terms.

How RELOOP works through our retail partners 

      23. You opt-in to participate in RELOOP through the RELOOP widget on the product detail page on our retail partner's website. 

      24. You purchase an eligible item through our retail partner's website. Eligible items will have a RELOOP widget below the "Add To Bag" button on the product detail page on our retail partner's website. Once you checkout an eligible item with RELOOP opted in, you will be invited to create a RELOOP account (or sign in, for existing customers). If you do not register at this time, GlamCorner will send you one or more emails with details regarding RELOOP, including information about how to register for RELOOP.  

      25. You verify your email address through the verification email we send to you. 

      26. When we make the functionality available, you may also sign up/log into RELOOP items directly through GlamCorner. We will specify eligible items to be listed directly in RELOOP from time to time.  

      27. You complete a RELOOP listing form for each of the items you wish to RELOOP and GlamCorner either sends you a RELOOP Starter Kit to the address you specify in the RELOOP listing form for each of your items or a shipping label for your to print (ie if you already have a suitable box for your item(s))

      28. You use the RELOOP Starter Kit (or a suitable alternative package) to send your item(s) to GlamCorner's Fulfilment Center.   

      29. Once received, GlamCorner will assess your item(s) to confirm that the item(s) meets the Product Listing Guidelines. 

      30. If your item(s) fails to meet the Product Listing Guidelines, we will comply with clauses 55 to 57 below. If your item(s) meets our Product Listing Guidelines, your item(s) will be submitted for listing on our website for the Minimum Listing Period. 

      31. We will manage the process of arranging a photoshoot for your items, content writing, marketing, customer enquiries and management of your items including minor repairs, cleaning, delivery and logistics, as required.

      32. If a third party customer purchases your item, we will comply with clauses 43 to 47. 

      33. If a third party customer does not purchase your item during the Minimum Listing Period, we may decide to remove the listing at any time by complying with clauses 58 to 61.

How RELOOP works - through https://reloop.com.au  

      34. You register for a RELOOP account (or sign in where you already have a RELOOP account). You verify your email address through the verification email we send to you. 

      35. You complete a RELOOP listing form for each of the items you wish to RELOOP and GlamCorner either sends you a RELOOP Starter Kit to the address you specify in the RELOOP listing form for each of your items or a shipping label for you to print (ie if you already have a suitable box for your item(s)).

      36. You use the RELOOP Starter Kit (or a suitable alternative package) to send your item(s) to GlamCorner's Fulfilment Center.   

      37. Once received, GlamCorner will assess your item(s) to confirm that the item(s) meets the Product Listing Guidelines. 

      38. If your item(s) fails to meet the Product Listing Guidelines, we will comply with clause clauses 55 to 57 below. If your item(s) meets our Product Listing Guidelines, your item(s) will be submitted for listing on our website for the Minimum Listing Period. 

      39. We will manage the process of arranging a photoshoot for your items, content writing, marketing, customer enquiries and management of your items including minor repairs, cleaning, delivery and logistics, as required. 

      40. If a third party customer purchases your item then your item has been successfully RELOOPed and we will comply with clauses 43 to 47. 

      41. If a third party customer does not purchase your item during the Minimum Listing Period, we may decide to remove the listing at any time by complying with clauses 58 to 61.

How will the resale price of your items be determined?

      42. GlamCorner will provide a recommended listing price through the listing form however you determine the price at which we will list your item(s) through the tools available when you log into your account and list items. 

Successful RELOOP

      43. Where a third party customer purchases your item, the third party purchaser will pay GlamCorner for your item. 

      44. For every item successfully sold, GlamCorner will retain a 30% commission of the net proceeds (sale price minus any promotional discount, shipping, refunds and GST) and pay the remainder to your bank account within 7 Business Days after the item has successfully been RELOOPed. 

      45. An item is considered as successfully RELOOPed when: 

            a) the item has been received by the third party customer and the third party customer has not made a request to return the item within 24 hours of delivery pursuant to the GlamCorner Terms and Conditions; and

            b) payment for your item is received by GlamCorner from the third party customer in cleared funds.

      46. Once your item has been successfully RELOOPed, until GlamCorner pays you pursuant to clause 44, GlamCorner will hold your proportion of the proceeds of the sale of your item on trust for you as trustee.

      47. We may pay a fee to our retail partner which will be taken from our fee referred to in clause 44 above. 

Information shared with our retail partner 

      48. Upon a successful RELOOP pursuant to clause 44 above, we will provide the following information to the retail partner from which you originally purchased the item (if you opted into RELOOP at the time of purchasing the item from that retail partner): 

            a) your full name; 

            b) original order number and order date; 

            c) the amount for which the item was successfully RELOOPed; and 

            d) the fee to be paid by GlamCorner to the retail partner for the successful RELOOP. 

What if your items fail to meet the Product Listing Guidelines?

      49. If your item(s) fails to meet the Product Listing Guidelines, we will return your item(s) to you at your cost, unless you have chosen a different option pursuant to clauses 55 to 57;  

What if your items meet the Product Listing Guidelines?

      50. If your item(s) meets our Product Listing Guidelines, your item(s) will be submitted for listing on our website for the Minimum Listing Period. 

Proof of purchase 

      51. You must send GlamCorner proof of purchase of your item(s) if requested from GlamCorner within 5 Business Days of such a request - preferably a purchase receipt to ensure the authenticity of the item(s). 

When will we refuse to list your item(s)?

      52. GlamCorner will not list an item if it does not meet the Product Listing Guidelines. This includes: 

            a) the item cannot be authenticated, including where GlamCorner is not satisfied that the item is authentic;

            b) you do not provide proof of purchase upon request pursuant to clause 51; 

            c) GlamCorner suspects that the item may be counterfeit, stolen or otherwise obtained or attempted to be sold unlawfully; or 

            d) the item is otherwise unfit for sale. 

53. GlamCorner may also refuse to list an item if GlamCorner determines that the proposed listed price is excessive. 

      54. GlamCorner reserves the right to decline your item in its sole discretion if your item does not meet the Product Listing Guidelines, including the conditions set out above.

What happens if GlamCorner refuses your item? 

      55. When you complete a RELOOP listing form you will select one of the following options for GlamCorner to follow if GlamCorner refuses your item:

            a) GlamCorner to recycle your item; and 

            b) GlamCorner to return your item back to you, at your cost.

      56. If you choose the option at clause 55a), we will do our best to recycle your item. However not all items can be recycled. If your item cannot be recycled, we will dispose of it in another manner.

      57. You acknowledge and agree that where GlamCorner suspects an item meets the description in clause 52c):

            a) GlamCorner may contact the relevant authorities to notify them of the item, without notifying you; 
            b) GlamCorner may contact the relevant designer/manufacturer or fashion house to notify them of the item, without notifying you; and 
            c) you bear the risk that the item may be seized by the appropriate authorities or relevant designer/manufacturer or fashion house, and the item might be destroyed or detained, and GlamCorner will not be liable for the item or for any consequences in such an instance and action may be taken against you by us or by any third parties. 

What happens if we do not sell your item?

      58. We make no warranties or representations that we will sell your item(s). 

      59. Your item(s) will be listed for the Minimum Listing Period unless they are sold during this time. GlamCorner may determine, in its sole discretion, to remove your item any time after the Minimum Listing Period expires. 

      60. If we do not sell your items during the Minimum Listing Period, we may contact you by email and ask you whether you would like us to: 

            a) recycle your item; or  

            b) return your item to you at the address we originally sent the RELOOP Starter Kit (or another address you notify to us). 

      61. If you do not respond within 90 days of our notice referred to in clause 60, we will either recycle your item (eg donate your item to a local charity) or dispose of your item in another way at our sole discretion in accordance with applicable laws. 

What happens if you want GlamCorner to return your item prior to it being RELOOPed?

      62. If you change your mind about selling your item through RELOOP, you can delist your item and request that GlamCorner return your item to you (at your cost) through the tools available when you log into your account and access your listings. 

      63. Clause 62 does not apply once your item is sold to a third party customer.  

GST 

      64. In clause 65, the expressions Consideration and GST have the meanings given to those expressions in the A New Tax System (Goods and Services Tax) Act 1999.

      65. Unless otherwise expressly stated, all prices or other sums payable or Consideration to be provided under or in accordance with these Terms are inclusive of GST.

Indemnity 

      66. You agree and acknowledge that you will fully indemnify GlamCorner in respect of all Loss, (including legal fees on a full indemnity basis) and Claims however arising, whether at common law (including negligence) or under statute, in connection with:

            a) any breach of these Terms by you; or 

            b) your use of RELOOP, including any wrongful, wilful or negligent act or omission,

            except to the extent covered by our wrongful, wilful or negligent acts or omissions, or our breach of these Terms. 

Termination of your RELOOP account  

      67. You will be fully responsible for all acts and omissions of any person using your password and RELOOP account, as if they were your own acts and omissions. You agree that you will not share, disclose, or permit disclosure of, your password, let anyone else access your RELOOP account or do anything that would risk the security of your RELOOP account. GlamCorner will not in any event be liable for any Loss arising out of the use or misuse of your password and RELOOP account, and you will indemnify GlamCorner against all Loss in this regard.

      68. You must notify GlamCorner immediately if you become aware of any unauthorised access or use of your RELOOP account.

      69. GlamCorner reserves the right to refuse registration of any RELOOP account, or to disable or terminate any RELOOP account, at GlamCorner's sole discretion including if you breach any of these Terms. 

      70. You agree that you must not create more than one personal RELOOP account and if we disable or terminate your RELOOP account for any reason, you will not create another one without GlamCorner's permission, whether through the use of your own personal details or those related to you or created by you.

Disputes

      71. If you have any concern regarding these Terms or RELOOP, please contact GlamCorner at hello@glamcorner.com.au and GlamCorner will consider our grievances however reserves the right to resolve the dispute in the manner it determines most appropriate, acting reasonably.

Variations 

      72. RELOOP is subject to change at any time without notice and may contain errors. We may from time to time review and update these Terms including to take account of new laws, products or technology. Your use of RELOOP will be governed by the most recent Terms posted on the Store. By continuing to use RELOOP, you agree to be bound by the most recent Terms. It is your responsibility to check the Store regularly for updated versions of these Terms. 

General 

      73. Clause 25 (General) of the GlamCorner Terms and Conditions apply to these Terms.


Terms and Conditions for RELOOP Offer on eBay:
           

              74. This offer is provided by RELOOP, and entitles Eligible Customers to 33% off the RELOOP selling fee (or ‘commission’) for Eligible Items sold via RELOOP (“Offer”).


               75. “Eligible Customers” means eBay customers who:
                        a) Receive the Offer email to their eBay account;
                         b) opt in to the Offer and sign up to RELOOP via eBay, including agreeing to the RELOOP Terms of Service; and
                         c)are located in Australia.

                76. For every Eligible Item an Eligible Customer has listed with RELOOP between 1 April 2023 and 30 June 2023, they will receive 80% of the net proceeds (meaning the final sale price minus any promotional discount, shipping, refunds and GST) (“Net Seller Payout”), with RELOOP retaining a selling fee (or ‘commission’) of 20%. For the avoidance of doubt, this represents a 33% discount on the RELOOP standard selling fee/commission of 30% of the net proceeds.

                  77. “Eligible Items” means products in re-saleable condition with a recommended retail price (RRP) of AUD $150 or higher, and which otherwise comply with the RELOOP Product Listing Guidelines as may be amended from time to time. Whether an item complies with the RELOOP Product Listing Guidelines shall be at the sole discretion of RELOOP.

                  78. Net Seller Payout amounts will be paid to Eligible Customers by RELOOP, via bank transfer, within 14 business days of each completed sale of an Eligible Item..

                   79.This Offer is provided by RELOOP, not eBay. eBay and RELOOP are not in any way related corporate entities and eBay has no control over RELOOP. Customers agree that their sole avenue for recourse for any dispute which may arise in connection with this Offer shall be with RELOOP, and eBay disclaims any liability related to a customer’s participation in the Offer.

                  80. RELOOP reserves the right to terminate the agreement with Eligible Customers who engage in, or who RELOOP reasonably believes have engaged in any fraudulent, misleading or other illegal practices.

                  81. This Offer may be withdrawn or modified at any time without notice by RELOOP in its reasonable discretion.
